Duty of Care Under Section 34 of the Environmental Protection Act 1990, any person who imports, produces, carries, keeps, treats, disposes of or, as a dealer or broker has control of, controlled wastes has a Duty of Care to prevent the escape of the waste from their control or that of any other person and to ensure that the transfer is only to an authorised person and in accordance with a Waste Transfer Note or Hazardous Waste Consignment Note. Failure to comply with the Duty of Care is an offence with no upper limit on the courts’ power to fine.
